Agreement Overview: This agreement ("Agreement") is between you ("Student") and MyRealEstateSchool.com ("MRES"). By clicking the "Accept" button, accessing our Site, or using our online courses, you agree to the terms of this Agreement.
Security and Validation Policy: Student acknowledges that it is illegal to circumvent our online courses. Any attempt to circumvent may result in loss of Certificate of Completion, fines, and forfeiture of payment. Misrepresentation of identity may lead to removal from the course and possible legal consequences. MRES may use third-party databases to verify the accuracy of your information and prevent fraud. You may be required to provide a notarized Statement of Assurance verifying your identity if requested by MRES.
Tuition and Payment: The total cost of the course is provided at the time of purchase.
Course Access and Schedule: Courses are available 24/7 after payment is received. There is no set time limit to complete the course, except for students in specific states (California, North Carolina, New York, Tennessee). Students are responsible for their own equipment and internet connection. If you encounter access issues due to MRES's fault, contact us at 800-861-7325 to adjust your course end date.
Refund Policy: Full refunds are available if the course is not completed and the request is made within 30 days of purchase. "Completion" means all levels of the course are finished, regardless of exam results. Course extension purchases are not refundable. Refunds for purchases made through Apple iTunes must be requested through Apple.
Cancellation Policy: Full refund available for cancellations made within 30 days of signing the enrollment contract, unless the course is completed.
Subscription Billing: Monthly or recurring billing is charged to your payment method on the calendar day corresponding to the start of the paying portion of the registration. Update your payment methods through our payment service providers. MRES reserves the right to change subscription plans or pricing with notice to the student.
Student Obligations: Provide accurate, current, and complete information during registration. Maintain and update your information as needed. Students under 18 must have a legal guardian's consent.
Account Security: Create a login ID and password during registration. Keep your password and account information confidential. Notify MRES of any unauthorized use of your account.
Prohibited Activities: Do not sell or exploit any part of the course or access for commercial purposes.
Important Notices: This agreement includes a class action waiver and a mandatory arbitration clause. By accepting this agreement, you waive your right to a jury trial.
Use and Storage: MRES is not responsible for deletion or failure to store communications or content. Accounts inactive for an extended period may be logged off.
Termination: MRES may terminate your access to the course if you violate this agreement. Termination may occur without prior notice. Upon termination, all rights granted to the student will revert to MRES.
Criminal History: A criminal history may affect your eligibility for a license. Consider requesting a Fitness Determination before applying for a license.
Intellectual Property: All content in the course is the property of MRES. You are granted a limited license to use the course for its intended purpose.
Liability Limitation: MRES provides the course "as is" and does not guarantee uninterrupted or error-free service. MRES's liability is limited to the cost of tuition paid.
Indemnification: You agree to indemnify and hold MRES harmless from any claims arising from your use of the course.
Delays in Services: MRES is not liable for delays caused by events beyond our control.
Assignment: You grant MRES the right to use information you provide during the course. This agreement cannot be assigned without MRES's written consent.
Notices: Notices to students may be made via email, regular mail, or on our Site.
Privacy Policy: By accepting this agreement, you agree to our Privacy Policy.
Governing Law: This agreement is governed by the laws of the State of Michigan. Any disputes will be resolved in Michigan.
Class Action Waiver: You agree to bring claims against MRES only on an individual basis, not as part of a class action.
Waiver of Right to Jury Trial: You waive your right to a jury trial for any claims related to this agreement.
Arbitration Clause: Any claims related to the course will be resolved through binding arbitration in Michigan.
Attorney’s Fees: MRES is entitled to recover attorney’s fees and costs if we take action to enforce this agreement.
No Conflicting Terms: This agreement supersedes any conflicting terms in other documents related to the course.
General Information: This agreement constitutes the entire agreement between you and MRES. If any provision is found invalid, the remaining provisions will remain in effect. Claims must be filed within one year or be forever barred.
